Owner/promoter with family must physically reside in the establishment.
Maximum guest capacity is six rooms and twelve beds.
Two classifications exist: Silver and Gold, with explicit room/bathroom and facility standards.
Scope: Source-checked regulatory and business-planning guidance. It does not approve a particular title, building, tax position, food activity or operating structure.
01 / Executive finding
The practical starting point
- The current controlling homestay instrument located is the Directorate of Tourism Notification F. No. 14-4/IIB&B/TSM/2009/, dated 22 February 2013, titled *Guidelines for approval and registration of Andaman & Nicobar Bed & Breakfast / Home Stay Establishment Scheme*. No later official amendment, rescission or replacement of this scheme was located. Its continuing operational relevance is supported by the Tourism Department's 2025 approved B&B/Homestay lists and a 2026 NSWS approval record. [S1, Notification; S2; S4]
- Classification is available only where the owner/promoter, together with his or her family, physically resides in the same establishment. A non-resident owner using only a caretaker therefore does not satisfy the located definition. Whether a resident lessee can be treated as the “promoter” is not expressly resolved. - The permitted guest inventory is minimum 1 and maximum 6 rooms, with maximum 12 beds. The source limits the rooms being let to guests; it does not expressly state that the whole building may contain no more than six rooms. [S1, Detailed Guidelines cl.1; Annexure II item 3; Annexure B item 2]
- The notified scheme says it applies “all over the A & N Islands”, but that is tourism-scheme coverage, not permission to develop every parcel. Tribal-reserve restrictions, land-use controls, municipal/building law, forests, wildlife/eco-sensitive areas and ICRZ/IIMP controls remain independent. [S1, Annexure B item 1; S7, s.40(2); S11; S13]
- There is no domicile, permanent-resident or “Islander” requirement stated in the 2013 tourism notification. That absence must not be confused with landholding, tenure, tribal-area or passenger-access rules. [S1, Detailed Guidelines and Annexures I–III — no such condition located]
- Homestays are classified as Silver or Gold. Silver room minimums are 120 sq ft urban/100 sq ft rural; Gold minimums are 200 sq ft urban/120 sq ft rural. Bathrooms are 30 sq ft Silver and 40 sq ft Gold. [S1, Annexure II items 4 and 7]
- Classification is valid for three years. Reclassification should be sought three months before expiry if continuity from the previous classification expiry date is required. [S1, Detailed Guidelines cl.4]
- The classification committee is chaired by the Director (Tourism); the committee inspects and recommends, and the recommendation is approved by the Secretary (Tourism). [S1, Detailed Guidelines cls.8–9]
- The notification states that complete classification cases “would be finalized within 30 days.” This is a stated administrative processing period in the scheme, not a statutory guarantee that approval will issue within 30 days. [S1, Detailed Guidelines cl.16]
- The official sources are not aligned on fees. Detailed Guideline cl.6 calls ₹1,000 Silver/₹2,000 Gold the classification/reclassification application fee, while Annexure B item 5 calls those amounts a registration fee and item 13 separately states an ₹100 application fee. No current public portal screen resolves whether ₹100 is additional, obsolete or otherwise handled. [S1, cl.6; Annexure B items 5 and 13]
- The official sources are not aligned on the application channel. The Tourism Department's legacy application page instructs applicants to use NSWS, while the current NSWS Andaman & Nicobar page, last reviewed 07 August 2026, reports 0 approvals found; the separately indexed homestay approval record states that the permission cannot presently be applied for through NSWS. A written Tourism Department answer is required before payment/submission. [S3; S4; S5]
- A company, LLP, partnership, trust, society or professional-management company is not expressly identified as an eligible homestay registration holder in the 2013 instrument. The form speaks of promoters/owners, but the controlling residence test requires owner/promoter with family to live in the establishment and Annexure III is signed by the owner. A juridical-person registration route must therefore not be published as settled. [S1, cl.1; Annexure I fields 3 and 10]
- Foreign guests trigger a separate current central obligation: Rule 17 of the Immigration and Foreigners Rules, 2025 expressly includes homestays, requires electronic accommodation records for at least one year, and requires Form III arrival and departure reporting within 24 hours. 02 / Document chronology
Use the current rules and implementation
- 1956–1957 — Protection of Aboriginal Tribes framework. Regulation No.3 of 1956 and reserve notifications establish a pre-existing protected-area regime. The 21 April 1957 notification restricts non-tribal entry into reserved areas except under authorised pass/conditions. Later reserve notifications and amendments exist and must be checked for a specific site. [S13]
- 1966 — Land Revenue and Land Reforms Regulation. Section 40 separately controls diversion from one assessed land use to another. Tourism classification does not amend this requirement. [S7, s.40]
- 1994 onward — planning and municipal framework. Municipal construction controls and Town & Country Planning instruments operate separately from tourism registration. [S8; S9; S30]
- 1999 — Port Blair Municipal Council Building Bye-Laws, subsequently affected by newer amendments including the 2025 Sri Vijaya Puram building amendments. The 1999 text must not be used without the amendments. [S9]
- 2009 — A&N Tourism Policy. This is useful historical context but is not the controlling 2026 homestay instrument. Its older coastal-setback or general subsidy propositions must not be carried forward without newer implementing authority. [S29]
- 22 February 2013 — B&B/Home Stay Notification. This is the current operative homestay-specific instrument located. [S1]
- 2014 and 2017 — Tourism Trade Regulations files. Both texts say they come into force on a date to be appointed by a later Lieutenant Governor Gazette notification. No commencement notification was located. They therefore cannot safely be treated as enacted current hotel/guest-house law. [S26, cl.1(iii); S27, cl.1(iii)]
- 2017 — PBMC Solid Waste Bye-Laws. Applicable in municipal limits. [S10]
- 8 March 2019 — ICRZ Notification 2019, S.O.1242(E). It superseded the 2011 IPZ framework as provided in the notification, with application dependent on updated/approved island plans. [S11]
- 2025 — current coastal and building developments. A&NCZMA was reconstituted by S.O.2512(E), 9 June 2025; SPMC lists 2025 building amendments. [S9; S12, p.55]
- 1 September 2025 — Immigration and Foreigners Rules, 2025. These replaced the previous foreigner-reporting framework to the extent specified and now expressly define homestays as accommodation under Rule 17. [S15]
- 30 July 2025 — latest Tourism Department approved B&B/Homestay list located. It demonstrates continued operation of the 2013 classification framework. [S2]
- 1 April 2026 — FSSAI licensing reforms/threshold changes effective. Older official FSSAI pages that still display ₹12 lakh are stale on this point; the 2026 order/FAQ controls the current threshold statement. [S17]
- 2026 — portal mismatch remains. Tourism directs applicants to NSWS, while NSWS's state page last reviewed 7 August 2026 reports no available A&N approvals. [S3–S5] No express instrument rescinding the 2013 homestay notification was located.

Start with the exact property address and local-body category. A. Is there already a specific property?
- No — only capital/idea exists: no classification application can yet be prepared because the Tourism form requires a named establishment, exact premises, title/lease information, room areas, public areas and photographs. Not established in the published material for any pre-property or in-principle homestay classification. → Confirm this in writing with the authority only if an applicant wants a formal pre-development tourism indication.
