Before you choose the property
Start with the rules that actually shape the project.
Chandigarh now has a formally permitted B&B/homestay route for qualifying residential premises.
The minimum qualifying residential-unit size is 500 square yards.
Chandigarh Tourism is the operative Tourism Department route and currently publishes B&B/Homestay links/contact information.
Scope: Source-checked regulatory and business-planning guidance. It does not approve a particular title, building, tax position, food activity or operating structure.
01 / Executive finding
The practical starting point
- Chandigarh now has a specific administrative route permitting Bed & Breakfast (B&B) use in qualifying residential properties. The current Chandigarh Tourism website separately links a “Bread & Breakfast/Homestay Policy” and a “Bed & Breakfast/Homestay permission notification”, while an official Chandigarh DPR release confirms that the Administration has notified B&B use of residential premises.
[S1, current Tourism homepage; S4, official DPR release] - The clearest currently verifiable property gate is that an eligible residential unit must have a minimum size of 500 square yards. This appears in the official Chandigarh DPR description of the notified permission.
[S4, official DPR release] - The underlying 2026 Estate/land-use permission is materially important because a tourism certificate cannot by itself authorise a residential building to be used for guest accommodation contrary to Estate rules. Contemporaneous reports identify the legal mechanism as a notification under Rule 9(i) of the Chandigarh Estate Rules, 2007, but the full final notification file and notification number could not be retrieved from an official downloadable source during this review. The proposition should therefore be reproduced publicly only after the notification itself is obtained.
[S4; D1; D3] - Contemporary reports of the final permission state that the owner—not a tenant or lessee—must apply and reside at the premises. This is a major departure from the Tourism Department's earlier draft policy, whose clause 3(2)(a) said that it was *not mandatory* for the family to physically reside. Because the final notified file could not be inspected directly, the current owner-residence wording should be treated as a high-priority verification item rather than silently reconciled with the draft.
[S3, cl. 3(2)(a); S4; D1] - The only full Chandigarh Tourism B&B policy text located on the official Tourism domain is explicitly labelled a draft inviting objections/suggestions. It cannot safely be represented as the current controlling policy merely because it remains downloadable. It contains detailed proposed provisions on classification, guest registers, inspection, parking, bathrooms, fire safety, displays, penalties and appeals, but those provisions require comparison against the final policy before publication as settled law.
[S3, title and cls. 1–21] - The draft's room provision is not publication-safe. Clause 3(2)(b) reads that the owner shall let out “up to 8 rooms or more per homestay unit”, wording that is internally inconsistent. Current official primary material located in this review did not establish a definitive maximum number of guest rooms, beds or total guest capacity.
[S3, cl. 3(2)(b)] - Chandigarh Tourism is the apparent registration/classification authority. The current official contact route is Chandigarh Tourism, 4th Floor, Paryavaran Bhawan, Madhya Marg, Sector 19-B, Chandigarh, with the Tourism website providing the department's B&B links and helpline/contact details. The draft additionally identifies the Secretary Tourism as appellate authority, but that appellate provision is not treated as final until the current policy is obtained.
[S1; S2; S3, cl. 2(a)] - An online B&B application process was reported as launched in August 2026, including reported Silver and Gold classification options. The authenticated application workflow, final public checklist, classification score sheet and live declaration text could not be independently inspected through the official Tourism site in this research. No account was created and no declaration, payment or application was submitted.
[D2, discovery only; S1] - B&B application fee, classification fee, inspection fee, renewal fee, payment mechanism and refund rule were Not stated in the current official material reviewed. The draft merely refers to prescribed fees without establishing a current amount.
[S3, cls. 3, 14 and 17] - Current B&B certificate validity is also unresolved. The draft says three years, while contemporaneous reporting of the final system describes annual renewal. No final official certificate-validity provision was retrieved. This must remain visible as an unresolved point.
[S3, cl. 3(8); D1] - Separate national obligations remain important. A homestay serving food may be a Food Business Operator subject to FSSAI/FoSCoS requirements; from 1 April 2026, the general turnover categorisation is registration up to ₹1.5 crore, State Licence above ₹1.5 crore and up to ₹50 crore, and Central Licence above ₹50 crore. FSSAI registrations/licences now have perpetual validity unless suspended, cancelled or surrendered.
[S8, paras. 3–5; S9, FAQ Q1–Q4] - Every keeper of accommodation, expressly including a “home stay”, who accommodates a foreigner or OCI cardholder must comply with Rule 17 of the Immigration and Foreigners Rules, 2025: electronically maintain the prescribed particulars for at least one year and transmit Form III within no more than 24 hours after arrival and 24 hours after departure.
[S10, r. 17(1), (5)–(7)] - No current official Chandigarh Tourism source reviewed established a B&B-specific capital subsidy, interest subsidy or automatic financial incentive. Chandigarh currently operates wider MSME/RAMP/PMEGP-related programmes through its Industries Department, but B&B eligibility and benefit amounts were not confirmed in this research and must not be advertised as a homestay entitlement.
[S17; S18] - There is not yet enough primary evidence to publish a fully settled Chandigarh homestay guide. The most consequential missing items are the complete final Tourism policy, the final Estate permission notification with number and conditions, the live application checklist/declarations, definitive room/capacity limits, fees, validity/renewal rules and final Silver/Gold classification standards.

02 / Document chronology
Use the current rules and implementation
2006–2007 — Paying Guest framework
Chandigarh had a separate Paying Guest accommodation regime under 2006 and 2007 orders. A later official 2020 amendment refers back to them. This is a different accommodation category and must not be used to fill gaps in the B&B scheme. [S7]
2008 — earlier Chandigarh B&B scheme
Contemporary 2026 reporting states that Chandigarh previously introduced a B&B scheme in 2008 and later withdrew it after misuse. The original 2008 instrument and the official withdrawal/rescission order were Not stated in the current official material reviewed reviewed for this guide. Accordingly, no detailed legal proposition is based on that reported history. [D1, discovery only]
25 July 2017 — Chandigarh Building Rules (Urban), 2017
Notification No. 201711/2/70-UTFI(4)-2017/6994 introduced the Chandigarh Building Rules (Urban), 2017 and superseded specified earlier building-control instruments. Subsequent amendments in 2018, 2019 and 2020 were located on Chandigarh Administration/Finance Department sources. [S5; S6]
2020 — Paying Guest amendment
The separate PG regime was amended to address sanctioned construction, completion/occupation issues, fire NOC, renewal and enforcement. It remains useful principally to demonstrate that Chandigarh treats PG accommodation through a separate legal route. [S7]
2026 — Tourism B&B draft
Chandigarh Tourism uploaded draft_bed_breakfast_policy_cor.pdf, explicitly requesting objections/suggestions. The draft proposed a comprehensive B&B registration regime. Its exact issue/publication date and document/order number were not located. [S3]
June 2026 — final Estate permission
Contemporary reports dated 27 June 2026 state that the Estates Department notified residential B&B use under Rule 9(i) of the Chandigarh Estate Rules, 2007 with the Administrator's approval. The underlying official notification file/number could not be retrieved, although the later official DPR press release confirms the permission and 500-square-yard minimum. [S4; D1; D3]
3 July 2026 — official DPR confirmation
The Chandigarh Department of Public Relations published press release no. 4571 confirming that the Administration had notified use of residential premises for B&B establishments. [S4]
August 2026 — online application reported operational
A 22 August 2026 report states that Chandigarh Tourism had begun accepting online applications and referred to Silver/Gold classifications. The Tourism website currently carries the B&B links, but applicant-only form screens were not inspected. [S1; D2]
Supersession conclusion
The B&B draft cannot be assumed to have become the final policy unchanged. No express final instrument was located that states, clause-by-clause, what parts of the draft were adopted, amended or deleted. Current result: the 2026 final Estate permission is later and hierarchically more relevant to residential-use permission, but the current final Tourism classification/registration text remains incomplete in the accessible record.
03 / Category definitions
Choose the right accommodation category
| Category | Location | Eligible owner/applicant | Residence requirement | Operator allowed | Capacity | Food position | Source |
|---|---|---|---|---|---|---|---|
| Bed & Breakfast / homestay | UT Chandigarh; qualifying residential premises | Current final wording not fully retrieved. Draft says owner applies. Official final permission confirms ≥500 sq yd; discovery reports say owner, not tenant/lessee | Draft says family need not physically reside; later final reporting says owner must reside — not aligned | No current final rule located allowing a separate registration holder. Draft definition of “owner” includes an authorised person in charge of management, but that does not prove transferability | Current final room/bed limit Not stated in the material reviewed; draft cl. 3(2)(b) is ambiguous | Draft defines B&B as lodging plus food and restricts outside dine-in/cloud-kitchen activity. FSSAI remains separate | [S3, cls. 2–3, 7; S4; D1] |
| Paying Guest accommodation | Chandigarh residential properties under separate PG orders | Separate PG policy; not the B&B route | PG source includes resident-owner/family concepts | Separate policy | Separate PG capacity/space rules | Separate from tourist B&B | [S7] |
| Hotel | As authorised by planning/building/tourism laws | Not stated in the material reviewed in B&B final source | No B&B residence rule imported | Separate commercial accommodation route | Separate | Separate FSSAI/GST etc. | Draft expressly excludes hotels [S3, cl. 1(4)] |
| Motel | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Draft excludes motels [S3, cl. 1(4)] |
| Guest house | Separate commercial/accommodation category | Not stated in the material reviewed in current B&B source | No B&B rule imported | Not stated in the material reviewed | Not stated in the material reviewed | Separate | Draft excludes guest houses [S3, cl. 1(4)] |
| Boarding/lodging house | Separate category | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Separate | Draft excludes such establishments [S3, cl. 1(4)] |
| Serviced accommodation/apartment | Not stated in the current official material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not established in the published material |
| Farm stay | Not stated in the current official material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not stated in the material reviewed | Not established in the published material |

The practical distinction is important: a property that fails Chandigarh's residential B&B eligibility does not become lawful merely by calling itself a “homestay”. It may require another accommodation/use category and separate planning permissions.
04 / Eligibility decision tree
Check whether the applicant and property qualify
Step 1 — Establish the exact property address and jurisdiction.
- Is the property within UT Chandigarh?
- No: does not appear to fit the published homestay definition.
- Yes: continue.
- Is the building governed by the Chandigarh Building Rules (Urban), a village/Abadi Deh regime or another special planning control?
- Unknown: Confirm this in writing with the authority.
- Known: continue. Step 2 — Establish the property's sanctioned use and size.
- Is it a lawful residential unit?
- No or commercial/institutional/other use: Consider another accommodation category.
- Unclear sanctioned use or unauthorised additions: Confirm this in writing with the authority.
- Yes: continue.
- Is the qualifying residential unit at least 500 square yards?
- No: does not appear to fit the published homestay definition.
- Yes: continue.
[S4]Step 3 — Identify title and applicant. - Individual owner proposing to apply:
- continue.
- Tenant/long-term lessee:
- current discovery material says the final notification excludes tenant/lessee applicants, while the accessible draft is owner-based. Confirm this in writing with the authority before any commercial commitment.
- Company/LLP/partnership/trust/society:
- current final source expressly permitting these applicants was Not stated in the material reviewed.
- Not established in the published material.
- Joint owners/heirs:
- co-owner consent/application treatment Not stated in the material reviewed.
- Confirm this in writing with the authority. Step 4 — Establish residence.
- Will the owner actually reside on the premises?
- Yes: likely consistent with the later reported final permission; continue.
- No: draft cl. 3(2)(a) would have allowed non-residence, but later final reporting says the owner must reside. Confirm this in writing with the authority.
[S3; D1]Step 5 — Establish operator. - Owner/family operates:
- continue.
- Caretaker runs the house while owner resides there:
- operational possibility may exist, but caretaker status under final policy is Not stated in the material reviewed.
- Confirm this in writing with the authority.
- Professional management company handles bookings/housekeeping/guest operations:
- no current final provision confirms that an outside operator can replace the registration holder.
- Confirm this in writing with the authority.
- Owner lives elsewhere and only caretaker/company is present:
- likely inconsistent with reported final owner-residence rule.
- Confirm this in writing with the authority. Step 6 — Test proposed room and bed plan.
- Definitive current maximum rooms/beds confirmed from final official policy?
- No.
- Draft cl. 3(2)(b) is internally ambiguous.
- Not established in the published material. Do not construct or commercially model around an assumed eight-room entitlement until Tourism confirms the final rule in writing. Step 7 — Property status.
- Existing compliant residence, no material works: proceed to Tourism/document review.
- Existing building requiring renovation/extension: building/planning approval must be checked first.
- Vacant residential land/new construction: no evidence was located that B&B approval can be pre-secured before lawful residential development. Confirm this in writing with the authority.
- Running unregistered accommodation: do not infer grandfathering. Confirm this in writing with the authority. Step 8 — Adjacent compliance. If the premises serves food, receives foreign guests, employs staff, changes building use/configuration or lies near a protected/environmentally sensitive location, separate approvals/reporting may apply. Research classification for the clearest case: an individually owned, lawful residential unit of at least 500 square yards, with the owner genuinely resident and a room plan within whatever final Tourism cap applies, This appears to fit the published route, subject to the remaining checks, subject to final Tourism classification and all address-specific approvals.
05 / Applicant and operating structures
Set the ownership and operating structure
| Structure | Supported route | Main obstacle | Source | Question requiring clarification |
|---|---|---|---|---|
| Resident individual owner | Strongest apparent fit: owner applies for qualifying residential premises and remains resident | Final policy/checklist still required; room cap unresolved | [S3; S4; D1] | Confirm exact final owner-residence wording and documentary proof |
| Joint/inherited ownership | Potentially possible if Tourism accepts the ownership arrangement | Co-owner consent, succession evidence and nominated applicant rules Not stated in the material reviewed | [S3] | Must all co-owners sign? Can one co-owner register with consent? |
| Owner living elsewhere | Draft once contemplated this | Later final reporting says owner must reside | [S3, cl.3(2)(a); D1] | Does final notification require continuous owner residence? |
| Owner with caretaker | No current final prohibition/permission located for assistance by caretaker | Caretaker cannot be assumed to replace required resident owner | [S3, cl.2(l)] draft only | May a caretaker manage day-to-day operations while owner remains resident? |
| Long-term lessee | No supported current registration-holder route located | Final reporting expressly says tenant/lessee cannot apply; accessible draft is owner-based | [S3; D1] | Is any registered long-term lease acceptable, or are all non-owners excluded? |
| Company | Not established in the published material | “Family”, owner residence and residential-owner concepts may not map to a company | [S3; S4] | Can a company owning a residential property qualify? If so, whose residence satisfies the rule? |
| Partnership firm | Not established in the published material | No explicit applicant provision located | [S3] | Can a firm be registration holder? |
| LLP | Not established in the published material | No explicit permission; an LLP agreement does not create residential-owner eligibility | [S3] | Can an LLP own/apply and how would residence be satisfied? |
| Trust/society | Not established in the published material | No current source located | — | Are institutional/non-natural owners excluded? |
| Professional operator/management company | Could potentially provide services under owner contract, but registration-holder separation is unproven | Draft's authorised-manager language is not enough to prove the final policy permits outsourced operation | [S3, cl.2(l), cl.20] | What functions may be delegated without transferring/assigning the certificate? |
| Capital-only participant, no property | No Tourism application can sensibly begin until an eligible property/applicant structure exists | Capital alone does not satisfy property/title/residence requirements | [S4] | Which acquisition/partnership structures preserve B&B eligibility? |
| Landowner proposing new construction | Develop lawful residential building first, subject to building/planning approvals | B&B pre-clearance for proposed construction Not stated in the material reviewed | [S5; S6] | Will Tourism give a pre-application feasibility letter based on plans? |
Important: a management agreement, revenue-sharing agreement, LLP, operating company or caretaker arrangement cannot by itself cure an ineligible title holder, undersized plot, non-residential sanctioned use or owner-residence requirement.

08 / Application and inspection process
Follow the application and inspection process
The following sequence combines what is securely established with steps contained in the official Tourism draft. Draft-derived steps are marked accordingly.
| Step | Responsible person/authority | Input/document | Resulting record | Stated time | What does not happen automatically |
|---|---|---|---|---|---|
| 1. Address/property feasibility | Owner + Estate/building authorities | Exact address, title, plot size, sanctioned use, plans | Eligibility assessment | No current period located | Tourism status does not legalise an otherwise unlawful building |
| 2. Test 500-sq-yd threshold | Applicant/Tourism | Title/site area | Basic eligibility | N/A | Passing size test does not guarantee B&B approval |
| 3. Confirm applicant/residence eligibility | Applicant/Tourism/Estate | Ownership and residence evidence | Eligibility finding | Not stated in the material reviewed | Owner residence cannot be assumed from title |
| 4. Create online account | Applicant | Contact/identity details | User account | Not stated in the material reviewed | Account creation is not registration |
| 5. Complete application | Owner/applicant | Form fields, room/property details | Submitted application | Not stated in the material reviewed | Submission is not approval |
| 6. Upload supporting records | Applicant | Title/building/other documents | Application file | Not stated in the material reviewed | Upload does not validate documents |
| 7. Pay fee, if prescribed | Applicant | Online/offline payment | Receipt | Amount/method Not stated in the material reviewed | Payment does not guarantee inspection/approval |
| 8. Scrutiny | Tourism/prescribed authority | Application file | Scrutiny/query | Draft only | Draft says authority sends application to classification committee |
| 9. Inspection | Classification committee | Property, facilities, checklist | Inspection findings | Draft only | Inspection does not guarantee classification |
| 10. Deficiency notice | Committee/Tourism | Inspection deficiencies | Rectification requirement | “Stipulated time” in draft; exact period Not stated in the material reviewed | Failure may result in rejection under draft |
| 11. Reinspection/evaluation | Committee | Rectified property | Evaluation report | Not stated in the material reviewed | Rectification does not compel approval |
| 12. Classification | Committee/Tourism | Checklist score | Category recommendation | Not stated in the material reviewed | Silver/Gold criteria not located |
| 13. Registration decision | Tourism | Committee report | Certificate or refusal | Draft proposes one month for entire process | Draft timeline is not treated as statutory current guarantee |
| 14. Certificate/display | Owner | Approved registration | Certificate/display | Current format Not stated in the material reviewed | Tourism certificate does not replace FSSAI, foreigner reporting, tax, building or fire duties |
| 15. Appeal/refusal challenge | Applicant | Appeal and order | Appellate decision | Draft: appeal within 30 days; proceedings within four months | Final current appeal framework not confirmed |
Under the draft, the classification committee could identify deficiencies and require correction; failure to correct them in the stipulated time could lead to rejection. [S3, cl.3(3)–(7)] The draft also proposes completion of the “entire process” within one month of receipt of the application. Because the final policy was not located, this is not a guaranteed current processing time and should not appear in public copy as “approval in 30 days”. [S3, cl.3(9)]

10 / Operating duties after registration
Run the registered homestay correctly
Certificate and residential operation
The draft requires conspicuous display of the registration certificate and continued residential character, including no separate front office. Current final wording was not retrieved. [S3, cls.6–7]
Rates and guest information
The draft requires display/communication of accommodation and food charges, food type, employee names and checkout time, and requires guests to be informed in advance about accommodation, facilities, food and rates. [S3, cl.6(v), (vii)] Current final rate-display and billing rules are Not stated in the material reviewed.
Invoices
A specific Chandigarh B&B invoice format, serial-number requirement or record-retention period was Not stated in the material reviewed. GST invoicing obligations, if applicable, arise separately under GST law.
Domestic guest identity and register
The draft requires a register/computerised record containing detailed guest information and proposes periodic transmission to local authority/police. Exact final domestic guest-ID fields, acceptable IDs and retention period were Not stated in the material reviewed. [S3, cl.6(i)–(ii)]
Reported fortnightly guest information
Draft clause 6(ii) proposes sending guest information to the local authority and police every fortnight on the 15th and last day of the month. This is a draft provision and should not yet be published as a settled 2026 Chandigarh reporting duty.
Foreign guests — current mandatory central rule
This requirement is current and independent of the Chandigarh Tourism draft. Rule 17 of the Immigration and Foreigners Rules, 2025 requires every keeper of accommodation to:
- collect required information from every foreigner, including an OCI cardholder;
- obtain/sign arrival and departure information;
- maintain the information electronically for at least one year;
- transmit Form III electronically within 24 hours after arrival; and
- transmit departure details within 24 hours after departure. “Accommodation” expressly includes a home stay.
[S10, r.17(1), (5)–(7)]The current government reporting portal is the Bureau of Immigration/FRRO Form C environment.[S11]
Tourism statistics
A separate current monthly occupancy/arrival/statistics return imposed by Chandigarh Tourism was Not stated in the material reviewed. Do not confuse the draft's fortnightly guest-information proposal with a verified monthly tourism-statistics return.
Staff and police verification
Draft clause 6(iii) requires police verification of employees. The current final implementation process, forms, timing and categories of staff were Not stated in the material reviewed.
Incident reporting
A Chandigarh B&B-specific accident, death, crime or serious-incident reporting protocol was Not stated in the material reviewed. General police/emergency and other legal duties may nevertheless apply.
Food
Where breakfast or other food is supplied as a food business, FSSAI compliance must be assessed separately. Current FSSAI turnover categorisation from 1 April 2026 is:
- Registration: up to ₹1.5 crore;
- State Licence: above ₹1.5 crore and up to ₹50 crore;
- Central Licence: above ₹50 crore. These are general categorisation thresholds; other activity-specific criteria may apply.
[S8]FSSAI registration/licence now has perpetual validity unless suspended, cancelled or surrendered; this does not remove hygiene/safety obligations.[S9, Q4]
Complaint route
The draft allows written complaints supported by evidence to the prescribed authority by email/post and provides for enquiry/removal if substantiated. The current final complaint procedure was Not stated in the material reviewed. [S3, cl.9]
Suspension, cancellation and penalties
The draft proposes:
- removal/revocation for ownership change, specified conviction, insolvency, breach or adverse effect on neighbours;
- show-cause notice before removal;
- publication of revoked establishments;
- return of certificate within seven days;
- possible restoration;
- monetary penalties for specified breaches, false information, assignment of certificate and refusal to produce documents. Because the source is a draft, none of these penalty figures should be presented as current operative penalties without the final policy.

Building-rule caution
The Chandigarh Building Rules (Urban), 2017 and subsequent amendments remain separate from Tourism classification. Building-use legality, extensions, completion status and fire/structural requirements should therefore be checked from the actual property file before renovation or launch. [S5; S6]
GST caution
Section 22 of the CGST Act provides the general registration threshold of ₹20 lakh for suppliers in a State/UT other than special-category States, but section 24 contains compulsory-registration cases and current notifications/exemptions can alter practical treatment. Chandigarh B&B operators should therefore not use the ₹20-lakh figure as a universal “no GST below this amount” rule without considering the actual supply/OTA/entity structure. [S12, ss.22–24]
12 / Incentives, subsidy and funding
Evaluate incentives without assuming sanction
A. Chandigarh B&B-specific tourism subsidy
Official scheme name: Not stated in the material reviewed Eligible applicant/location: Not stated in the material reviewed Eligible expenditure: Not stated in the material reviewed Assistance amount/formula: Not stated in the material reviewed Bank route: Not stated in the material reviewed Application timing: Not stated in the material reviewed Sanction authority: Not stated in the material reviewed Current application status: Not stated in the material reviewed Finding: no current official Chandigarh Tourism source reviewed established an automatic or separately sanctioned capital subsidy, reimbursement or interest subsidy specifically for B&B/homestay registration.
B. RAMP-related MSME assistance
Scheme: Raising and Accelerating MSME Performance (RAMP) — Chandigarh implementation. Authority: Department of Industries, Chandigarh. Official current guidelines: a current “Working Guidelines for Application and Disbursement of Financial Assistance for MSMEs in UT Chandigarh under RAMP Programme” file is listed by Chandigarh Administration. [S17] For a Chandigarh B&B:
- eligible applicant: B&B/homestay applicability NOT CONFIRMED;
- eligible expenditure: NOT CONFIRMED for B&B;
- assistance type/amount: NOT RELIED UPON because the full current file could not be retrieved;
- bank route: NOT CONFIRMED;
- application window: NOT CONFIRMED OPEN for this use;
- sanction authority: Department-level route exists, exact B&B sanction route NOT CONFIRMED;
- automatic entitlement: No. No basis exists to treat the programme as an automatic homestay benefit.
C. PMEGP
Current Chandigarh Industries material confirms that the Department is involved in implementation of PMEGP. [S18] However, this guide does not establish that a Chandigarh B&B under the new 2026 policy qualifies for PMEGP assistance. Current sector eligibility, promoter contribution, project-cost ceiling, subsidy/margin-money rate, bank route and applicant restrictions must be tested under the current national PMEGP scheme and the proposed legal/entity structure. Therefore: Current B&B eligibility: NOT CONFIRMED Verified B&B benefit: Not stated in the material reviewed Automatic assistance: No Public website treatment: do not advertise PMEGP as a Chandigarh homestay subsidy.
Funding conclusion
Any financing model should be prepared without including a subsidy receivable unless the relevant agency or bank has independently approved it for the specific applicant/project.
13 / Business implications
Translate the rules into a workable project
Before selecting or acquiring a property
the project team should establish at minimum:
- exact Chandigarh address and governing planning/building regime;
- documentary residential use;
- actual plot/unit area and whether the 500-square-yard criterion is satisfied;
- owner/title structure;
- whether the intended applicant can satisfy the current owner/residence requirement;
- sanctioned plan and actual construction;
- completion/occupation position;
- unauthorised additions or misuse proceedings;
- parking feasibility;
- protected-area/environment/heritage issues;
- intended guest-room/bed count;
- whether final Tourism rules support that capacity;
- who will prepare/serve food;
- whether foreign guests are intended; and
- whether any third-party manager structure is acceptable. A capital-only participant should not be advised to purchase a property first and “obtain the homestay licence later” without completing these gates.
Before construction or renovation
The design brief should not assume:
- eight rooms are definitely permissible;
- all bedrooms can be converted for guest use;
- parking in the street will count;
- a front desk/reception can be constructed;
- an owner can move out after registration;
- a company/LLP can substitute for a resident individual owner; or
- Tourism registration cures building-plan discrepancies. Construction or alteration should be checked against the Chandigarh Building Rules and the property's sanctioned plans before work begins.
[S5; S6]
Registration holder versus operating entity
Current accessible final sources do not establish that the Tourism registration holder and the commercial operating entity may be different. The draft's definition of “owner” included a person authorised by the owner to be in charge of management. That may support operational delegation, but it does not prove that:
- the authorised manager may apply instead of the owner;
- the certificate can be held by an LLP/company;
- management rights may be assigned;
- owner residence can be replaced by caretaker residence; or
- a revenue-sharing operator acquires independent rights under the certificate. Indeed, the draft separately proposed a penalty for lending/transferring/assigning a registration certificate, reinforcing the need for explicit written clarification.
[S3, cls.2(l), 20]
What an LLP or management agreement cannot solve by itself
An LLP or management agreement cannot:
- enlarge an undersized property;
- convert non-residential sanctioned use into residential B&B use;
- cure title defects;
- cure unauthorised construction;
- satisfy an owner-residence requirement unless the final rules actually recognise the arrangement;
- create a room entitlement not contained in the policy;
- replace fire/building/FSSAI/foreigner-reporting obligations; or
- guarantee transfer of registration after sale or restructuring.
Property-development scope
Development scope depends on local approval for:
- alterations;
- additions;
- internal reconfiguration where approval is required;
- bathrooms/plumbing;
- fire-safety installations;
- parking/site treatment;
- structural modifications;
- façade/signage where controlled; and
- any change in sanctioned use or occupancy consequences.
Property assessment and commercial planning should record
- source and date of title evidence;
- plot/unit area;
- owner identity;
- actual residence plan;
- sanctioned versus existing floor plan;
- number of existing bedrooms;
- proposed letting bedrooms;
- bathrooms;
- parking;
- access;
- fire-safety condition;
- utilities;
- food-service model;
- staffing;
- management structure;
- OTA/direct-sales model;
- foreign-guest capability;
- GST/FSSAI assumptions;
- approval dependencies;
- unresolved government questions; and
- conditions precedent before money is committed.
Questions that must be answered before the project team proposes business terms
- Who is legally eligible to hold the B&B registration?
- Must that person continuously reside in the premises?
- Can a company/LLP own the property?
- Can a professional operator manage it?
- What is the final room/bed cap?
- What is the validity/renewal cycle?
- What changes terminate or require amendment of registration?
- What happens upon sale, succession or lease?
- Which NOCs are mandatory?
- What electricity/property-tax classification applies?
- What final Silver/Gold standard is intended?
- Are the building and title records clean enough to support registration? No fixed ownership share, capital contribution, revenue share, guaranteed income or return should be proposed on the basis of this regulatory guide.
14 / Official-source conflicts
Resolve conflicting official instructions
Conflict 1 — owner/family residence
Source A: Chandigarh Tourism draft, clause 3(2)(a). Proposition: it is not mandatory for the family to physically reside in the establishment. [S3] Source B: later 2026 reporting of the notified final permission. Proposition: owner—not tenant/lessee—must apply and reside on the premises. [D1; D3] Hierarchy/date analysis: Source A is explicitly a draft. A subsequently notified Estate permission would prevail for the land-use permission to the extent of inconsistency. However, because the complete final notification/policy text was not retrieved, the precise final residence condition cannot be reproduced clause-for-clause. Status: OFFICIAL FINAL TEXT NOT FULLY LOCATED; DRAFT SHOULD NOT BE USED AS CURRENT RULE. Affected properties: owner living elsewhere; caretaker-run homes; corporate-owned homes; inherited/joint homes; leased homes. Written answer required from: Chandigarh Tourism and Estate Officer/Chief Administrator.
Conflict 2 — room limit
Source A: draft clause 3(2)(b). Text: “up to 8 rooms or more per homestay unit.” [S3] The words “up to” and “or more” contradict each other. Source B: secondary final-policy reports typically describe an eight-room model, but no current final primary clause establishing the exact cap was retrieved. Status: OFFICIAL SOURCE INTERNALLY AMBIGUOUS / CURRENT FINAL RULE Not stated in the material reviewed. Affected properties: every project whose commercial or architectural model depends on number of rooms/beds. Authority: Chandigarh Tourism.
Conflict 3 — validity and renewal
Source A: draft clause 3(8). Proposition: registration certificate valid for three years unless revoked. Source B: later reporting of the final 2026 system describes annual licence renewal with updated documents. [D1] Hierarchy: draft cannot override a later final instrument, but the final official validity clause was not obtained. Status: OFFICIAL CURRENT POSITION Not stated in the material reviewed. Affected properties: all applicants and operating B&Bs. Authority: Chandigarh Tourism.
Conflict 4 — parking
Source A: draft clause 3(2)(e). Proposition: adequate parking either within the premises or in its vicinity. Source B: final-policy reporting uses language suggesting parking at/on the property. Because no final primary checklist was obtained, neither interpretation should be selected for acquisition purposes. Status: OFFICIAL FINAL POSITION Not stated in the material reviewed. Affected properties: residential streets with limited private parking. Authority: Chandigarh Tourism + Estate/municipal authority.
Conflict 5 — electricity classification
Source A: draft clause 16 proposes that power/water retain domestic/residential treatment. Source B: August 2026 portal reporting says applicants are asked for proof of an LTDS-III electricity meter. [D2] The actual official form and current tariff order were not inspected. Status: The official sources are not aligned / PORTAL FIELD NOT INDEPENDENTLY VERIFIED. Affected properties: all applications where meter conversion/tariff affects approval or operating cost. Authority: Chandigarh Tourism plus the current electricity distribution/tariff authority.
