The right route in Puducherry depends on the actual property, applicant and operating arrangement.

Before you choose the property

Start with the rules that actually shape the project.

Home Stay requires the owner/promoter and family physically residing in the same establishment.

Home Stay capacity is 1–3 guest rooms / maximum 6 beds.

B&B capacity is 1–4 guest rooms / maximum 8 beds, and the owner/promoter need not reside there.

Scope: Source-checked regulatory and business-planning guidance. It does not approve a particular title, building, tax position, food activity or operating structure.

01 / Executive finding

The practical starting point

  • The principal Puducherry-specific instrument located for homestays is G.O.Ms.No.02/Tsm/2019 dated 12 November 2019, notifying the *Guidelines for Approval and Registration of Puducherry Bed & Breakfast and Home Stay Establishments Scheme* throughout the Union Territory. No later Puducherry Tourism amendment, rescission or replacement of this scheme was located in the official sources reviewed. [S1, p.1; S2, notification page]
  • Puducherry deliberately separates Home Stay from Bed & Breakfast. A Home Stay is classifiable only where the owner/promoter and his or her family physically reside in the same establishment; a B&B expressly does not require the owner/promoter to stay on the premises. [S1, p.3, cls.1–2]
  • A Puducherry Home Stay may let minimum 1 and maximum 3 rooms, with maximum 6 beds. A B&B may let minimum 1 and maximum 4 rooms, with maximum 8 beds. The guidelines do not state that these are caps on all rooms in the building rather than rooms offered to guests. [S1, p.3, cls.1–2; p.7, item 3]
  • No minimum Puducherry domicile, nativity or specified number of years of UT residence was located. The police-verification form records the owner's residence and asks since when the person has resided there, but prescribes no minimum period. [S1, p.10, Annexure A]
  • The scheme applies throughout the Union Territory of Puducherry. The classification checklist distinguishes urban and rural room-size standards, but the 2019 instrument does not define how “urban” and “rural” are to be determined. [S1, pp.1, 7, item 4]
  • Puducherry Home Stay/B&B establishments are classified as Silver or Gold. The Classification Committee is chaired by the Director of Tourism and includes the relevant Municipality/Commune Panchayat Commissioner, jurisdictional Superintendent of Police and Hotel Association representative; the Chairman plus any two members form quorum.   • Verified Home Stay classification/reclassification fees are ₹12,000 for Silver and ₹15,000 for Gold. The application form additionally asks for proof of payment of a ₹100 application fee. Registration is valid for three years from issue. [S1, p.3, cls.5(b), 7; p.6, field 8]
  • The strongest practical restriction is structural, not merely documentary: a Home Stay cannot be made compliant simply by placing a caretaker or professional manager in the property because the published definition requires the owner/promoter with his or her family to be physically resident. A non-resident owner may instead need to examine the B&B category. [S1, p.3, cls.1–2]
  • The application expressly allows property particulars to be shown as “owned/leased” and asks for a sale deed or lease deed, yet Annexure III is expressly signed by the owner, and the registration automatically ends on a change of ownership. The instrument does not clearly state whether a lessee may independently be the registration holder. This requires written Tourism Department clarification before publication of any lessee route.   • No provision was located expressly allowing a company, LLP, partnership firm, trust, society or professional management company to hold the Home Stay registration, or expressly allowing the registration holder and operating entity to differ. Those routes must therefore not be represented as settled. [S1, pp.3, 5, 9]
  • The tourism registration does not determine lawful building use, planning permission, completion/occupancy issues, municipal/commune trade licensing, CRZ or heritage constraints, fire requirements, FSSAI obligations, GST treatment or foreign-guest reporting. Puducherry maintains separate planning, local-body, coastal, fire and labour systems. [S7–S18]
  • The 2019 scheme states that applications are to be scrutinised and cleared through a single-window process within 30 days and says an “in principal approval” will be given if inspection has not occurred after 30 days, but it expressly makes that status subject to the Classification Committee's decision. It is therefore not a guaranteed final approval period. [S1, p.4, cl.16]
  • No current public online portal dedicated to Home Stay/B&B registration was located in the Department's current services page or the Puducherry Government's current online-service directory. The public 2019 annexures appear to remain the only inspectable application material found. The Department should confirm the current submission and payment route in writing. [S1, pp.5–10; S5]
  • Foreign guests are now governed by the Immigration and Foreigners Rules, 2025, not the superseded Registration of Foreigners Rules, 1992. Rule 17 expressly includes a home stay within “accommodation”; Form III arrival information and departure information must be electronically transmitted within 24 hours, and the accommodation record must be retained electronically for at least one year.   • The core resident-owner Home Stay rules are sufficiently well evidenced, but you should still confirm the current submission/renewal mechanism, lessee/entity/operator eligibility and any post-2019 unpublished departmental instructions. The Department's own website warns that website circulars should not be treated as statements of law and that hard-copy departmental instruments prevail where conflict exists. 02 / Document chronology

Use the current rules and implementation

Tourism-specific chronology

12 November 2019 — G.O.Ms.No.02/Tsm/2019. The Lieutenant Governor approved and notified the Puducherry B&B and Home Stay Establishments guidelines throughout the UT. The instrument states that the guidelines were based on the Government of India's Incredible India B&B/Home Stay guidelines, but the operative Puducherry requirements are those actually notified in the Puducherry order. [S1, pp.1–2] 2019–05 September 2026 — no later Home Stay amendment/rescission located. Searches of the current Puducherry Government notification material, Tourism Department site, current UT online-service directory and Tourism services pages did not locate an amendment, corrigendum or replacement Home Stay order. This is a negative research finding, not proof that no internal departmental circular exists. [S2, S5] Current comprehensive tourism-policy position. A Ministry of Tourism Swadesh Darshan 2.0 destination master-plan document states: “Currently, Government of Puducherry doesn’t have a tourism policy” and recommends development of one. That statement concerns a comprehensive tourism policy; it does not repeal the specific 2019 Home Stay/B&B scheme. [S19, p.138]

Adjacent chronology relevant to a property

  • 1964: Puducherry Catering Establishments Act — separate labour/employment regime. [S18]

  • 2012 onward: Puducherry Building Bye-Laws and Zoning Regulations, subsequently amended. [S7]
  • 2024: heritage-building notification material for the Boulevard. [S22]
  • 2025: Immigration and Foreigners Rules, 2025 became effective on Gazette publication on 1 September 2025 and superseded the 1992 Registration of Foreigners Rules, among other instruments. [S12, r.1]
  • 2025–2026: continuing PPA building/land-use amendments and notifications. [S7]
  • 1 April 2026: revised FSSAI turnover categorisation came into effect. [S14, para 5] No earlier Puducherry-specific Home Stay scheme that the 2019 order expressly repeals or supersedes was located.

The 2019 order should therefore not be used to invent a regulatory definition for “villa,” “guest house,” “serviced apartment,” “farm stay” or similar marketing labels.

Check whether the applicant and property qualify

Start with the exact property address and local-body category.

  1. Is the exact plot/building address known, including Municipality/Commune Panchayat and planning jurisdiction?
  • No: planning, CRZ, heritage and trade-licence status cannot be tested → Not established in the published material for the specific project.
  • Yes: verify present land use, sanctioned building position and any CRZ/heritage overlay before committing to development → if unresolved, Confirm this in writing with the authority.
  1. What is the property-right position?
  • Individual owner with clear title → continue.
  • Joint/co-owned property → application expressly contemplates an affidavit where there is a co-sharer; continue only after confirming all title/consent issues → This appears to fit the published route, subject to the remaining checks if the residence/capacity tests below are satisfied.
  • Long-term lease → Annexure I accepts “owned/leased” property documentation, but the scheme does not clearly confirm a lessee as registration holder → Confirm this in writing with the authority.

Key structural point: an LLP, shareholder agreement, lease or management agreement may organise money, risk and commercial rights, but it cannot by itself rewrite the person-and-residence conditions in the published Home Stay definition.

Translate the rules into a workable project

Before selecting or acquiring property

the project team should establish, for every candidate address:

  • local body and planning jurisdiction;
  • title and encumbrance position;
  • whether proposed structure is owner-occupied, leased or another arrangement;
  • actual person proposed as Tourism registration holder;
  • whether that person and family will physically reside there if Home Stay classification is intended;
  • number of guest rooms/beds;
  • urban/rural classification for room-size purposes;
  • lawful land/building use;
  • sanctioned-plan and completion/occupancy position;
  • CRZ status;
  • heritage status;
  • access/parking feasibility;
  • water/sewerage capacity;
  • fire requirements; and
  • whether existing rooms can actually satisfy Silver/Gold dimensions and attached-bathroom requirements. A low acquisition price cannot remedy a property that structurally cannot satisfy the intended regulatory category.

Before construction or renovation

Do not design from the Tourism checklist alone. Design decisions should be tested simultaneously against:

  • planning/building rules;
  • intended occupancy/use;
  • heritage controls;
  • CRZ controls where relevant;
  • fire/life-safety rules;
  • municipal requirements;
  • tourism room/bathroom sizes;
  • parking/access;
  • water/sewerage;
  • kitchen/food requirements; and
  • accessibility requirements applicable to the building. The current OBPS system checks building proposals against the Puducherry Building Bye-Laws and zoning rules and routes applications through Registered Technical Personnel. [S8]

Registration holder versus operating entity

The 2019 rules do not establish that the Tourism registration holder and a separate professional operating company may be different. Accordingly:

  • an owner can contract services commercially, but the contract cannot be represented as Tourism approval of the operator;
  • a management company cannot be assumed to satisfy the Home Stay residence condition;
  • an LLP cannot “hold” the registration merely because it has an agreement with the property owner;

Property-development scope

A landowner beginning with an undeveloped site should treat the project as a development-approval problem first and a Tourism-classification problem later. S1 speaks of classifying fully operational rooms; it is not a pre-construction development consent. [S1, p.2]

Resolve conflicting official instructions

Conflict 1 — leased premises versus owner-centric registration documents

Source A: Annexure I, field 6(a), explicitly asks whether the property is owned/leased and requests a sale deed or lease deed. [S1, p.5] Source B: Annexure III is expressly executed by the owner, and cl.5(b) says registration automatically cancels upon change of ownership. [S1, pp.3, 9] Practical propositions:

  • Source A suggests leased premises are capable of being presented in an application.
