Before you choose the property

Start with the rules that actually shape the project.

The located current published Gujarat definition requires the owner and family to physically reside at the establishment as principal residence.

Homestay capacity is 1–6 lettable rooms and maximum 12 beds.

The current policy expressly recognises a lease route only where Government is the lessor, subject to its stated conditions.

Scope: Source-checked regulatory and business-planning guidance. It does not approve a particular title, building, tax position, food activity or operating structure.

01 / Executive finding

The practical starting point

  • Gujarat's current published operational instrument located for homestay registration is the Policy for Registration of Homestay Establishments Revised-2020, Government Resolution No. PVS-102020-HS-2-S, dated 21 December 2020. The current Gujarat Tourism Business Opportunities page, last updated 18 August 2026, still links this revised policy. A March 2026 GERC tariff order records that a Draft Homestay Policy 2025 existed but that the final policy had not then been issued; no later final 2025/2026 homestay instrument was located in current official sources. [S1, pp.1–2; S3, current page; S5, p.152]
  • The 2020 policy applies throughout the entire State of Gujarat. It defines a homestay around an owner and the owner's family physically living in the same establishment and letting rooms to tourists for payment. [S1, p.2, §§1–2]
  • The central eligibility condition is not merely Gujarat domicile: the property must be the house owner's principal place of residence, and the owner must physically reside there with family. A separate Gujarat domicile/permanent-resident certificate requirement was Not stated in the current official material reviewed. [S1, pp.2–3, definitions/eligibility]
  • The published scale is minimum 1 and maximum 6 lettable guest rooms, with a maximum of 12 beds. The policy does not establish in the retrieved text that the entire dwelling may contain only six rooms; it regulates the rooms let to guests. [S1, p.3]

  • Only an establishment registered as a Residential Unit/property with the concerned local authority is stated to be eligible for consideration.   • A Police Verification Certificate from the local police station in the prescribed Annexure E format is expressly required from the homeowner applicant. A separate staff/caretaker police-verification requirement was Not stated in the current official material reviewed. [S1, p.5]
  • Site inspection follows satisfactory document receipt and is to be carried out by a qualified agency appointed by the Commissioner of Tourism. The Classification Committee takes the final classification decision, and the Commissioner issues the registration certificate. [S1, pp.5–8]
  • A registration certificate is valid for two years. The homeowner may commence homestay business operations only after receipt of the certificate. Renewal is to be filed online at least 30 days before expiry. [S1, p.6]

  • The 2020 policy states that registered homestays are to receive RGP electricity rates, but a 25 March 2026 GERC tariff order rejected a DISCOM request to include qualifying homestays in the RGP/RGP (Rural) category because the final Homestay Policy 2025 had not been issued. 02 / Document chronology

Use the current rules and implementation

20 November 2014 — original Gujarat homestay GR, S2. It created a statewide Silver/Gold scheme. Among other things, it limited eligibility to residential houses existing before 31 March 2014, charged ₹100/₹200, required the owner/family to live on the premises and prescribed an appeal to the Secretary (Tourism) within 30 days. [S2, pp.1–7] 21 December 2020 — Revised-2020 policy, S1. The later GR expressly identifies the earlier 2014 GR in its history and says incentives and criteria required revision. It creates three classifications, changes fees and standards, revises the administering authority/process, permits the specifically defined Government-lessor lease situation and supplies a new set of annexures. An express clause using the words “repeal” or “supersede” in relation to the whole 2014 GR was Not stated in the current official material reviewed; nevertheless, where the two instruments directly contradict one another, the later instrument labelled “Revised-2020” is the operative published source used in this guide. [S1, pp.1–9] 1 January 2021–31 December 2025 — Gujarat Tourism Policy 2021–25, S6/S7. This was an investment-incentive policy, not a replacement homestay-registration code. Its operative period has ended. A property that fails the owner-residence definition should therefore not automatically be relabelled a B&B, guest house, hotel, farm stay or serviced accommodation. The competent current route for those categories needs to be established independently.

Start with the exact property address and local-body category.

For GST, CGST Act §22 contains the ordinary ₹20 lakh threshold for taxable suppliers in non-special-category states, but §24 lists compulsory-registration cases that can override the general threshold. A homestay should therefore not be told that “GST applies only above ₹20 lakh” without a fact-specific tax analysis covering its supplies and distribution channels. B. Gujarat Tourism Policy 2021–25

The Tourism Policy 2021–25 incentive period ended 31 December 2025. No successor Gujarat tourism incentive scheme covering homestays was located during the current official search. Scheme: Development of Homestays in Tribal Areas, a sub-scheme of Swadesh Darshan under Pradhan Mantri Janjatiya Unnat Gram Abhiyan (PM-JUGA). Verified assistance: up to ₹5 lakh for village-community requirements, up to ₹5 lakh for construction of two new rooms for each household, and up to ₹3 lakh for renovation of existing rooms for each household. The central guidelines are framed around proposals formulated by State Governments/UT Administrations, not an unrestricted direct individual cash grant. PMMY is described by the Department of Financial Services as collateral-free institutional credit through banks, RRBs, small-finance banks, NBFCs, MFIs and other member lenders. Translate the rules into a workable project

Before selecting or acquiring a property, the project team should establish the exact parcel/local body, title, whether the proposed registration holder is an eligible resident owner, whether the property is or can lawfully become a residential unit, the proposed lettable-room/bed count, and whether the commercial arrangement relies on a lease, corporate owner or non-resident owner that the current policy does not clearly support. Before construction or renovation, the building-development route must be separated from tourism classification. Meeting a 120 sq ft or 200 sq ft bedroom standard does not authorize construction. The development authority/local body must first confirm the relevant sanctioned-plan, residential-use, BU/occupancy, fire, wastewater, access and other requirements for the actual site. The located policy does not establish that the homestay registration holder and the commercial operating entity may always differ. Annexure A's authorised-manager field supports the proposition that someone may manage operations, but it does not by itself establish that an LLP, company or third-party management company can hold the certificate, replace the resident owner or contract with guests as regulatory principal. Resolve conflicting official instructions

Conflict 1 — 2014 policy versus Revised-2020 policy

Source A: S2, GR PVS-10-2014-753615-S dated 20 November 2014. Source B: S1, GR PVS-102020-HS-2-S dated 21 December 2020. Material contradictions include:

  • S2 limits eligibility to houses existing before 31 March 2014; the located S1 eligibility text does not repeat that cut-off.
  • S2 has only Silver/Gold; S1 has Silver/Gold/Platinum.
  • S2's Silver minimum room area is 60 sq ft; S1 requires 120 sq ft.

Conflict 2 — RGP electricity concession

Source A: S1 p.4 says registered homestays shall receive RGP electricity rates. Source B: S5 p.152, dated 25 March 2026, says the Government had only a Draft Homestay Policy 2025 and that because the final policy was not yet issued, the DISCOM proposal to include registered homestays under RGP/RGP (Rural) was not accepted. Document hierarchy/practical effect: Tourism can state its incentive policy, but GERC controls tariff approval. The GERC order therefore creates a material implementation problem. The evidence does not justify telling an owner that registration will presently produce RGP billing. Status: The official sources are not aligned. This is not proof that no final instrument could exist anywhere in government records; it means the current source set is incomplete on the transition. Resolved implementation discrepancy — FSSAI portal “Renew”

FoSCoS still exposes a “Renew” menu, but FSSAI's March 2026 FAQ explicitly states perpetual validity and no renewal requirement for current registrations/licences under the revised framework. The later specific 2026 regulatory guidance controls the proposition stated in this guide.
